Warranty - claim conditions Footwear

We present to you the terms and conditions of the complaint - please read them!

Warranty - complaint conditions

  1. Goods sold through the website www.Monument.pl are covered by the manufacturer's warranty - its content and method of fulfillment are specified below.
  2. Footwear is warranted for 24 months when sold for personal use calculated from the time of issue.
  3. Footwear is warranted for 12 months when sold for professional, occupational or business use calculated from the time of issue.
  4. The warranty period is not the same as the lifespan of the footwear, which depends on the use of the aforementioned. recommendations for maintenance and use. Failure to comply with these recommendations will result in the loss of warranty rights.
  5. Warranty covers latent defects in footwear.
  6. Faster wear and tear of footwear can be caused by excessive use, not following the rules of use (the purpose of the footwear) and by lack of proper maintenance.
  7. Shoes that are clean, dry and unworn are accepted for complaint.
  8. Pre-sale complaints are accepted only for unused, clean shoes with no signs of use.
  9. Complaints of footwear worn, dirty, damaged, having mechanical damage are not considered.
  10. Complaints should be filed as soon as the footwear defect becomes apparent (i.e. at the time of the defect), in order to demonstrate the defects covered by the warranty.
  11. Complaints should be submitted to the Seller's showroom. Provide proof of purchase of the goods(e.g. receipt or invoice), the advertised footwear and the warranty claim form available at www.Monument.en. The complaint so reported will be considered within fourteen days from the date of delivery of the footwear by the warranty holder.
  12. Information about the processing of the complaint will be communicated to the Complainant, in particular, by providing him with an sms or e-mail message.
  13. The complainant has the right to demand repair of the goods or their replacement with new ones.
  14. The guarantor, after determining the validity of the complaint, will repair the goods or replace them with new ones.
  15. The guarantor is Monument.pl, address: Krakowskie Przedmieście 30, 20-001 Lublin, NIP: 9491344758. The warranty does not exclude, limit or suspend the buyer's rights under the warranty provisions for defects of the sold thing.
  16. The warranty does not cover:
  1. Poor fit of the shoe size to the user's foot;
  2. Comfort and convenience of footwear;
  3. In addition, mechanical damage (e.g., locks, buckles, soles), bruises, abrasions, seam abrasions, damage resulting from poor fit of footwear to the foot or its use inconsistent with its purpose, overt defects visible at the time of purchase, dirt, stains, stains, dirty footwear, worn, neglected, wet, unmaintained, shallow gaps on the edge of the glueing of the soles and improper maintenance are not subject to complaint. Damage resulting from natural wear and tear (e.g., soles, liners, heels, etc.) is also not subject to claim.);
  4. Degradation of materials due to cleaning substances / disinfectants / unsuitable for cleaning footwear;
  5. Soakage of footwear made of natural - noble leathers;
  6. Wetting of soles used inappropriately;
  7. Differences in skin color and texture;
  8. Folds, wrinkles formed during use and resulting from the natural properties of leather and leather-like materials;
  9. Footwear with overt defects, already visible at the time of sale;
  10. Slight discoloration of the interior of the shoe made of natural leather under the influence of sweat or wetness a determined according to the so-called "five-step gray scale";
  11. Damage resulting from insufficient maintenance and excessive wear of footwear;
  12. Discoloration of footwear or a half pair of footwear displayed as an advertisement on a shelf or store window and exposed to strong artificial or sunlight:
  1. In matters not covered by this chapter, the relevant provisions of the Civil Code shall apply.
  2. The provisions of this chapter shall not apply to the warranty for defects.

Conditions for complaints based on warranty provisions

  1. The customer has the right to file a complaint based on the provisions of the Civil Code, in particular
    in the case of contracts for the sale of goods, a complaint under the warranty for defects in goods
    (art. 556 and n. Civil Code).
  2. The seller is not liable under warranty for defects of which the customer was aware
    at the time of the agreement.
  3. The Seller informs that under certain conditions, within the limits allowed by law, it may offer a different solution than the one chosen by the Complainant (see. point 4 below). In order to carry out the complaint procedure quickly and efficiently, bearing in mind that not every demand of the Consumer may be legitimate under the provisions of the law, the Seller allows the Complainant to choose the order of the demands to which he is entitled, in case the first or the next in the declared order is not accepted.
  4. The Seller, in order to meet the interests of customers, below cites the content of the relevant articles of the Civil Code, which are the basis for submitting a complaint under the warranty and the choice of a specific request:

"Art. 560. § 1. If the sold thing has a defect, the buyer may make a statement
about reducing the price or withdrawing from the contract, unless the seller immediately and without excessive inconvenience for the buyer replaces the defective thing with a defect-free one or removes the defect. This restriction does not apply if the thing has already been replaced or repaired by the seller, or the seller has failed to comply with the obligation to replace the thing with a defect-free one or to remove the defect.

§ 2. If the buyer is a consumer, he may, instead of the removal of the defect proposed by the seller, demand the replacement of the item with a defect-free item or, instead of replacing the item, demand the removal of the defect, unless bringing the item into conformity with the contract in the manner chosen by the buyer is impossible or would require excessive costs compared with the manner proposed by the seller. In assessing the unreasonableness of costs, the value of the defect-free item, the nature and significance of the defect found shall be taken into account, as well as the inconvenience to which other means of satisfaction would expose the buyer.
§ 3. The reduced price should remain in such proportion to the contract price,
in which the value of the thing with the defect remains to the value of the thing without the defect.

§ 4. The buyer may not withdraw from the contract if the defect is insignificant.

Art. 561. § 1. If the sold thing has a defect, the buyer may demand replacement of the thing with a defect-free one, or removal of the defect.
§ 2. The seller is obliged to replace the defective thing with a defect-free one or remove the defect
within a reasonable time without undue inconvenience to the buyer.

§ 3. The seller may refuse to satisfy the buyer's request if it is impossible to bring the defective item into conformity with the contract in the manner chosen by the buyer or
compared to the other possible way to bring it into compliance with the contract would require excessive costs. If the buyer is an entrepreneur, the seller may refuse to replace the item with a defect-free item or remove the defect also if the cost of satisfying this obligation exceeds the price of the sold item.

  1. Please file a complaint at the Seller's showroom or send it to the Seller's address,
    i.e. Monument.pl ul.Krakowskie Przedmieście 30, 20-001 Lublin, with the annotation "complaint". In order to properly consider a complaint, the Seller requests: presentation of proof of purchase of the advertised goods (conclusion of the contract), submission of a statement (demand) with a description of the complaint along with the advertised goods.
  2. The consumer in order to file a complaint can use the template statement (request) with a description of the complaint, which is available on the website www.Monument.en.
  3. The time to respond to the request made in the complaint by the Consumer under the warranty for defects is fourteen days from the moment of its submission. This deadline does not apply to the submission of a declaration of withdrawal from the contract.
  4. Information about the processing of the complaint will be communicated to the Complainant, in particular, by providing him with an sms or e-mail message.
  5. If the complaint is accepted (the Consumer's request is justified), the Seller will satisfy the Complainant's request in accordance with his entitlement,
    i.e., m.in. the goods will be repaired or replaced free of charge, the price will be refunded or reduced.
  6. Each complaint is handled in accordance with the law. To the position of the Seller
    to the extent of the request made by the Consumer, will be accompanied by an opinion of a professional Expert or Footwear Manufacturer, based on the technologies used in the production of footwear.
  7. If it is not possible to replace the goods with a new one, the Seller may offer a refund to the Complainant. If the Complainant expresses such intention, such goods may be exchanged for another model with the possible obligation of the Complainant to pay a surcharge or with the return of the excess by the Seller.
