STORE REGULATIONS

§ 1. Definitions

1.1 Terms and Conditions – these Terms and Conditions set out the rules for concluding distance sales contracts via the Online Store, the rules for performing such contracts, the rights and obligations of the parties to the distance sales contract, and the complaint procedure. With regard to services provided electronically, these Terms and Conditions constitute the regulations referred to in Article 8 of the Act on the Provision of Electronic Services.
1.2 Customer – a natural person with full legal capacity, a legal person, or an organisational unit without legal personality but granted legal capacity by law, who concludes a distance sales contract with the Seller.
1.3 Consumer – a consumer within the meaning of Article 22¹ of the Civil Code. According to the statutory definition: a Consumer is a natural person performing a legal act with an entrepreneur that is not directly related to their business or professional activity.
1.4 Sole trader purchasing outside professional activity – a natural person concluding a distance sales contract directly related to their business activity where the content of the contract indicates that it is not of a professional nature for that person, in particular based on the scope of business activity registered in the Central Register of Business Activity. Such a person is entitled to: withdraw from the contract under rules granted to Consumers, rely on provisions concerning unfair contractual terms, and rights arising from statutory warranty for defects.

1.6 Registered address of the Seller – Aleja Najświętszej Maryi Panny 31, 42-200 Częstochowa.
1.7 Online Store – the website operated by the Seller at https://skatecapitol.com through which the Customer can obtain information about Goods, availability, purchase Goods or order services.
1.8 Distance sales contract – a contract for the sale of Goods/services/digital content (where applicable) concluded via the Online Store.
1.9 Goods – movable items available for purchase in the Online Store.
1.10 Privacy and Cookies Policy – a document specifying detailed rules regarding personal data processing and cookies. The policy constitutes Appendix No. 3 and is available at:

1.11 Durable medium – material or tool enabling storage of information addressed personally to the Customer or Seller in a way that allows future access and reproduction in unchanged form, including email.
1.12 Electronic order form – an electronic ordering procedure provided by the Seller.

1.14 Electronic complaint form – an electronic complaint submission procedure available at:

1.15 Submission of an order – confirmation of an order by clicking “Order and pay”, treated as a binding declaration of intent to conclude a distance contract.
1.16 Account – data stored in the Online Store relating to a Customer and their orders, enabling placing, editing or cancelling orders.
1.17 Order service rating & product rating – subjective ratings from 1–5 stars submitted by Customers after order completion.


§ 2. General provisions

2.1 Types of electronic services:
2.1.1 online sales contracts
2.1.2 account registration and use
2.1.3 adding opinions and comments
2.1.4 email confirmations regarding orders and payments
2.2 Minimum technical requirements:
2.2.1 modern browser (Firefox, Chrome, Internet Explorer or equivalent)
2.2.2 PDF viewing software
2.3 Content in the Online Store constitutes an invitation to conclude a contract under Article 71 of the Civil Code. It becomes binding only when the Customer clicks “Order and pay”.
2.4 The Seller provides these Terms and Conditions before, during, and after contract conclusion. The Customer may download and print them.
2.5 The Store uses technical and organisational security measures to protect transmitted data.


§ 3. Orders

3.1 Orders may be placed via an Account or without registration.
3.2 Orders are placed using the electronic order form by adding Goods to the basket and following instructions.
3.3 The order summary includes Seller details, Goods, price, delivery cost, payment method, delivery method, and delivery time.
3.4 For digital content/services delivered before the 14-day withdrawal period, the Consumer must consent:
“I consent to delivery of digital content or commencement of service before 14 days and acknowledge loss of withdrawal rights.”
3.5 Required steps: provide personal data, accept Terms, click “Order and pay”.
3.5.1 Submission constitutes a binding declaration
3.5.2 Contract concluded upon Seller acceptance
3.5.3 Email confirmation sent after conclusion
3.5.4 Before fulfilment Customer may modify or cancel
3.5.5 Cancellation refund within 3 working days
3.5.6 Processing time: 1–4 working days

§4. Payment

4.1 The Online Store offers payment options including advance payment, cash on delivery, or payment to account after delivery. Deferred payment is available only in individually agreed cases with the Seller.
4.2 Payment is made using the method selected in the electronic order form.

§5. Delivery

5.1 The Customer selects the delivery method in the electronic order form. The Seller reserves the right to change the delivery method at no extra cost to the Customer.
5.2 If the Customer fails to collect the Goods and they are returned to the Seller, the Seller may withdraw from the contract by email notification.
5.3 In such a case, the Seller will immediately refund the payment.

§6. Withdrawal from the contract – electronic return form

6.1 A Consumer who concludes a distance sales contract may withdraw within 14 days without giving a reason. The contract is then treated as not concluded.
6.2 This right also applies to sole traders purchasing outside their professional activity.
6.3 The Seller will verify eligibility by analysing registered business activity codes.
6.4 If the purchase is deemed professional in nature, the Seller will inform the Customer within 3 working days that withdrawal rights do not apply. Returned Goods will be sent back at the Customer’s expense.
6.5 The Consumer bears only direct return costs.
6.6 The withdrawal statement must clearly express intent. The Consumer may:

6.6.3 The Seller confirms receipt on a durable medium.
6.7 The deadline is met if sent before expiry.
6.8 The withdrawal period starts:

  • upon receipt of Goods
  • upon receipt of the last item in multi-part delivery
  • upon receipt of the first item in regular deliveries
  • or on contract date for services/digital content

6.9 Withdrawal forms and instructions are sent electronically.
6.10 Withdrawal rights do not apply to contracts including:

  • financial market dependent prices
  • customised goods
  • sealed hygienic goods after opening
  • sealed audio/video/software after opening
  • digital content delivered with consent
  • perishable goods
  • newspapers and magazines (except subscriptions)
  • public auctions
  • accommodation, transport, catering or leisure services with set date
  • alcohol with delayed delivery and variable market value

§7. Effects of withdrawal from a sales contract

7.1 Within 14 days of receiving the withdrawal statement, the Seller shall refund all payments made by the Consumer, including delivery costs corresponding to the cheapest delivery method offered.
7.1.1 Refunds will be made using the same payment method used by the Consumer.
7.1.2 If the electronic return form is used, funds will be returned to the bank account indicated by the Consumer.
7.2 The Seller may withhold the refund until the Goods are received back or proof of return is provided, whichever occurs first.
7.3 If the Seller does not offer collection, the Consumer must return the Goods without undue delay, no later than 14 days after withdrawal. Goods should be sent to the Seller’s registered address.
7.4 The Consumer is liable for any diminished value of the Goods resulting from use beyond what is necessary to establish their nature, characteristics, and functioning.


§8. Complaints

8.1 The Seller must deliver Goods free from physical and legal defects and is liable under statutory warranty rules.
8.2 If defects are found, the Buyer may submit a complaint:
8.2.1 via the electronic complaint form

8.2.3 The complaint must specify the defect, requested action, and proof of purchase. The Seller must respond within 14 days; failure to respond means the complaint is accepted.
8.2.4 Complaint procedure steps are shown in the electronic complaint form. If another method is used, the Seller will provide instructions accordingly.
8.2.5 If justified, the Seller bears replacement/repair/shipping costs.
8.2.6 The Seller verifies whether a sole trader complaint qualifies as non-professional.
8.2.7 If a dispute remains unresolved, the Seller provides a statement regarding participation or refusal in out-of-court consumer dispute resolution.


§9. Reviews

9.1 After order completion, Account holders may be invited to submit a rating and review by email. This is voluntary and free. Only one rating per order is allowed.
9.2 Ratings are 1–5 stars and optional written comments up to 65,535 characters. Reviews are automatically signed with the Customer’s first name and city.
9.3 Reviews are stored and displayed publicly on the Online Store and partner websites.
9.4 The Seller does not verify the content of reviews. The Customer is solely responsible for their statements. The Seller may block content in accordance with law and these Terms.
9.5 Prohibited content includes false, misleading, vulgar, offensive or unlawful material.
9.6 Customers must not post promotional links or personal data of third parties.
9.7 Customers are responsible for legal consequences of posted content.
9.8 At the Customer’s request, written content may be hidden, but the star rating remains included in overall scores.

§10. Intellectual property

10.1 The Customer declares that they do not hold any rights, including copyright or related rights, to reviews and statements posted in the Online Store beyond the right to use the Store in accordance with these Terms and Conditions. The Customer is not authorised to record, reproduce, publish or distribute Store content unless permitted by law or these Terms.
10.2 The Customer is not authorised to interfere with the content, structure, form, graphics, operation mechanisms, or any elements of the Online Store.
10.3 By posting reviews that constitute works under copyright law, the Customer grants the Seller a non-exclusive, royalty-free, unlimited licence in time and territory, including the right to sublicense to partners. This licence allows public access via the internet and includes all known fields of exploitation, in particular:
10.3.1 recording and reproduction by any technique, including print, digital, magnetic, audiovisual media, computer memory and networks
10.3.2 use in full or in part for publications, online media, advertising and promotional purposes
10.3.3 distribution, lending or rental of copies
10.3.4 public performance, display, broadcast or online access
10.3.5 marketing and promotional use
10.4 Deleting an Account or hiding reviews does not terminate the licence.


§11. Final provisions

11.1 These Terms and Conditions apply from 03.04.2025.
11.2 If any provision is declared invalid by a competent authority or court, the remaining provisions remain in force.
11.3 Polish law governs disputes related to these Terms. Disputes are resolved by the competent court. Consumers may also use out-of-court dispute resolution. Information is available on the Polish Office of Competition and Consumer Protection website. Such procedures are voluntary.

§12. Appendix 1 – Information on the right of withdrawal

12.1 The right of withdrawal also applies to sole traders purchasing outside their professional activity. Consumers have 14 days to withdraw without giving reasons. The period expires:

  • on receipt of goods
  • on receipt of the last item in multi-item delivery
  • on receipt of the last batch/part
  • on receipt of the first item in regular deliveries
  • on the contract date for services/digital content

Receipt confirmation will be sent on a durable medium.
12.5 Sending notice before the deadline is sufficient.
12.6 Payments, including standard delivery costs, will be refunded within 14 days unless a more expensive delivery option was chosen.
12.7 Refund may be withheld until goods are returned or proof of return is provided.

12.9 Due to size/weight, return shipping may cost more than standard post and may require pallet shipment.
